Whether it arises as a result of a title problem or a defendant’s answer/affirmative defenses this is an area of major concern for the secured creditor as it can result in increased costs and timelines.
If a case does become litigated or contested, our firm will actively seek to eliminate those defenses which may be without merit and filed simply to prolong the foreclosure process.
We will work with both pro-se defendants and those represented by counsel to adequately address their claims and to hopefully avoid the necessity for a lengthy litigation process. If these issues cannot be resolved amicably, our office will handle the case in the most expeditious and aggressive manner possible keeping in mind both the necessity to minimize our client’s costs and any potential exposure to loss they may have.
